How do I determine whether I am subject to FMCSA's safety regulations?

 

If you operate any of the following types of commercial motor vehicles in interstate commerce you must comply with the applicable U.S. Department of Transportation (USDOT) safety regulations concerning:

  • A vehicle with a gross vehicle weight rating or gross combination weight rating of 4,537 kg (10,001 lb) or more, whichever is greater;
  • A vehicle designed or used to transport between 9 and 15 passengers (including the driver) for compensation;
  • A vehicle designed or used to transport 16 or more passengers

Do I need to take a break?

 Drivers must take a 30-minute break when they have driven for a period of 8 cumulative hours without at least a 30-minute interruption. The break may be satisfied by any non-driving period of 30 consecutive minutes (i.e., on-duty not driving, off-duty, sleeper berth, or any combination of these taken consecutively). 

How many hours can I drive?

According to the FMCSA,  a driver is permitted to drive a maximum of 11 hours after 10 consecutive hours off duty. However, a driver is permitted to work a maximum of 14 hrs in a working period.

How long do I have to take off between shifts?

 A driver may not drive beyond the 14th consecutive hour after coming on duty, following 10 consecutive hours off duty. Off-duty time does not extend the 14-hour period. 

What is adverse driving conditions?

 Drivers are allowed to extend the 11-hour maximum driving limit and 14-hour driving window by up to 2 hours when adverse driving conditions are encountered.
